Where do I stand legally if my ex employer doesn't pay me?
I'm brazilian, but legal to work in USA. I've been working as a childcare provider for a family for 7 months. They used to pay me weekly. I found out I was pregnant 3 months ago. When I tell my boss she completely changes and after 1 month she tells me she is moving. I wouldn't work for her anymore, because it is too far now. She decided to move earlier and one day just called and said I didn't have to go anymore. It's been a month and I still didn't get my last pay check. She said she mailed it, but I never got it. Now she said the bank called her and they said the check was cashed. I didn't cash it and I don't think she is telling the truth.
Is there anything I can do?
I'm now 5 months pregnant, don't have a job and still didn't get my last pay check.
Tell her that you want to go to the bank and fill out an affidavit of forgery. That is what the bank will need in order to investigate check fraud (when someone signs your name to cash your check). Plus, throwing out fancy words like "affidavit" might get her to reconsider her lie and just issue you another check.
